The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 162/2015 registered in Police Station Vidhansabha, Dist: Raipur for offence punishable under section 302, 201 of Indian Penal Code.

As per the prosecution case applicant after consuming liquor has beaten his wife and baby child and thereafter because of such beating baby child died. Subsequently, a report was made by father-in-law of the accused and on enquiry it was revealed that the body was buried secretly and postmortem report reveals that death was due to asphyxia due to head injury 3.
Learned counsel for the applicant submits that applicant has been falsely implicated in this case but in fact there had been some quarrel in between husband and wife and child had fallen down, therefore death was caused and there was no intention to cause murder, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Perusal of the statement of the wife and the way the offence has
been committed, this court is not inclined to release the applicant on bail. 6.
Accordingly, the bail application is dismissed. Certified copy as per rules.
