1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973, as he was arrested in connection with Crime No. 79/2021, registered at Police StationBango, Korba (C.G) for the offence punishable under Section 302, 201, 120-B and 34 of IPC.

2) At the outset, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file afresh as and when occasion arises.

3) Counsel for the State has no objection to the above prayer.

4) Permission granted.

5) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
