1. Present is the 4th bail application filed under Section 439 Cr.P.C. for grant of bail to the applicant, who has been arrested in connection with Crime No. 19/2018 registered at Police Station Kukaner, District Sukma, Chhattisgarh for the offence punishable under Section 20-B of Narcotic Drugs and Psychotropic Substance Act. The 3rd bail application was rejected on 07.02.2020 vide MCRC No. 861/2020.

2. This Court while deciding the bail application on the previous occasion had taken into consideration the entire factual matrix of the case including the quantity of the contraband seized from the possession of the applicant, which was about 28 kgs. Further, from the proceedings it reveals that the applicant has been in custody only from 09.09.2018 i.e. till now he has not even undergone two years of custody period.

3. Given the said facts, this Court does not find any change in circumstances or any other strong case made out for entertaining the present bail application at this juncture. The bail application thus being devoid of merits stands rejected.

4. This Court while dismissing the bail application reiterates the directions that we have given to the trial Court while rejecting the earlier bail application to ensure that immediately on the reopening of the Courts after the recent close down in lieu of the Corona Virus Pandemic may take up this case and try to decide the matter as expeditiously as possible.

5. With the aforesaid directions the present bail application stands rejected.
