1. Learned counsel appearing for the petitioner would submit that the Commissioner, Surguja Division has dismissed the appeal of the petitioner as withdrawn on 17.10.2016, whereas the petitioner is interested for hearing the appeal on merits.
2. Be that as it may, the petitioner is at liberty to move an application for restoration of the appeal No.62/B-121/1516 before the Commissioner, Surguja Division.
3. If such application is filed, the Commissioner, Surguja Division would do well and decide the application of the petitioner as early as possible preferably within a period of three months from the date of receipt of copy of this order strictly in accordance with law on its own merit.
4. With the aforesaid observation, the writ petition stands finally disposed of. Certified copy of the order be returned to counsel for the petitioner after furnishing duly attested photocopy of the same. No order as to cost(s). Sd/- (Sanjay K Agrawal) Judge B/-
