1. This is second bail application filed under section 439 of the Code of Criminal Procedure relating to Crime No.160/2020 registered at Police Station Rajim, Distt. Gariyaband for the offence punishable u/s 376 & 450 of IPC. The first bail application was rejected on 06.01.2021.

2. As per the prosecution case, on 02.09.2020, the applicant who was a primary health worker went to the house of prosecutrix (victims) who are 3 in number and stated that he has to check Covid-19 infection and in such furtherance committed sexual assault with three women.

3. Learned counsel for the applicant is not able to substantiate any change of circumstances so as to reconsider the bail application within a short span of time.

4. Taking into consideration the fact that the earlier bail

application was rejected on 06.01.2021 and since the counsel for the applicant could not point out any vital change of circumstances, I do not find any reason to reconsider the bail at this stage. Accordingly, it is rejected. Sd/- GOUTAM BHADURI JUDGE R a o
