Judgment on Board Per Deepak Gupta, Chief Justice 24/11/2016 1.

By means of this so-called Public Interest Litigation, the Petitioner is challenging the appointment of Respondents No. 5 and 6 as Radiographer on the ground that they are not qualified.

The only grievance of the Petitioner is that Respondents No. 5 and 6 attained the essential qualification of passing class XII after doing the training of Radiology. We do not understand how this makes them unqualified. These people have been working for the last four years and whether they were Class X or Class XII is immaterial because now they have gained experience as Radiographers for four years. Furthermore, no explanation has been given why the Petitioner has been sleeping for four years.

There is no public interest involved in this petition. Therefore, the same is dismissed.
