1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973, as he was arrested on 16.04.2021 in connection with Crime No. 126/2021 for the offence punishable under Sections 307, 34 of IPC and Section 25, 27 of Arms Act, registered at Police Station- Supela, District- Durg (C.G.).

2) After arguing for sometime, learned counsel appearing for the applicant seeks to withdraw this application with liberty to repeat his prayer for bail by filing a fresh application, if the trial is not concluded within a period of six months from today.

3) Counsel for the State has no objection to the above prayer.

4) Permission granted.

5) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
