1. Heard on I.A. No. 1 application for grant of interim relief.
2. Counsel for the applicant does not want to press I.A. No.1, accordingly application is rejected without considering merits of the case.
3. This is the first bail application under Section 439 of the CrPC and there is no bail application is pending before any other Court.
4. Perused the case diary provided by the learned counsel for the State in connection with the Crime No.80/19 registered at Police Station Gidhuri, District Balodabazar-Bhatapara (C.G.) for the offence punishable under Section 34(2) of Excise Act.

Case of the prosecution, in brief is that on 04/04/2019, 12 bulk liters of hand made country liquor has been seized from the possession of the applicant. 7.
Counsel for the State submits that two other criminal case under CrPC have been registered against the applicant.

Looking to the above facts and circumstances of the case, the application is allowed. It is directed that if the applicant furnishes two solvent sureties each for a sum of Rs. 25,000/- along with one personal bond of Rs. 50,000/- to the satisfaction of the trial Court concerned with the condition that he will not involve himself in any of the crime in future, he be released on bail. 9.
