The applicant has preferred this bail application under Section 439 of the CrPC, as he has been arrested in connection with Crime No.495/2019, registered at Police Station Kasdol, District Baloda Bazar - Bhatapara (C.G.) for the offence punishable under Section 304-B read with Section 34 of IPC. 2.

The applicant and the deceased were married on 13.04.2019. She committed suicide by setting herself ablaze in her matrimonial house on 24.07.2019. As per the written report lodged by mother of the deceased, the in-laws of the deceased including the present applicant were ill treating her for demand of motorcycle and bringing insufficient dowry in the marriage.

The material available in the case diary would not indicate that demand was made directly to any of the member, it was the deceased who used to inform her parents about demand of dowry.

Learned State counsel would oppose the prayer for grant of bail. 5.

Considering that the co-accused Laxmi Sahu, Dukalu Sahu, Bhuvneshwar Sahu and Devmati Sahu have already been released on bail in MCRC Nos.5633 & 7445 of 2019 and the present applicant is in jail since 31.07.2019 and the trial may take sometime, this Court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court.
