Farukh Ahmad v. Shri Devesh Prasad
NAFR HIGH COURT OF CHHATTISGARH, BILASPUR Contempt Case (C) No. 402 of 2018 Farukh Ahmad, S/o Mohd. Abdul Rahim Khan, Aged About 53 Years, R/o Beside Rafique Dhenge Gali, Near Ajam Kirana Store, Naya Para, Raipur, Tahsil & District Raipur Chhattisgarh. ---- Petitioner
Versus
Shri Devesh Prasad, District Education Officer, Narayanpur, Chhattisgarh.
---- Respondent For Petitioner :
Shri Varunendra Mishra, Advocate.
For Respondent :
None.
Hon'ble Shri Justice Sanjay Agrawal Order On Board 20.07.2018 1.
Heard on admission.
2.
This Contempt Petition has been preferred for issuance of contempt proceedings against the respondent for disobedience of the order dated 12.02.2018, as passed by this Court in WPS No. 703/2018. 3.
Shri Varunendra Mishra counsel for the petitioner, submits that despite order passed by this Court on 12.02.2018, the respondent is not complying with the same, despite submission of an application in this regard on 08.03.2018. Thus, the contempt proceedings be drawn against the said authority.
4.
I have heard learned counsel for the petitioner and perused the entire relevant papers carefully.
5.
Undisputedly, the petitioner has been transferred from Higher Secondary School, Gariyaband to Higher Secondary School Narayanpur vide order dated 14.08.2017 on administrative ground. The record further shows that the petitioner has been relieved from Government Higher Secondary School, Gariyaband on 28.08.2017 and thereafter he joined the Higher Secondary School, Narayanpur on 20.11.2017. Since the petitioner has already joined on his transferring place of posting i.e. Higher Secondary School, Narayanpur even much prior to the order as passed by this Court on 12.02.2018, therefore, in such an eventuality, I am not inclined to draw the contempt proceedings in the matter.
6.
The Contempt Petition is accordingly dismissed. No order as to costs.
