1. The grievance of the petitioner seems to be the inaction on the part of the respondents in not confirming the services of the petitioner in spite of having worked under the respondents for more than 7 years.

2. According to the petitioner, he fulfills all the requisite eligibility criteria required in terms of the order of appointment on the post of Assistant Grade-III yet the authorities have till date not considered the claim of

the petitioner for confirmation in service. It is also the contention of the petitioner that even otherwise the very basis on which the conditions to the appointment order was issued i.e. circular of the State Govt. dated 17.02.2004 itself has been cancelled by the State Govt. and as such the said circular is of no relevance now, after it stood cancelled and therefore the petitioner's services ought to have been considered for confirmation in accordance with the service rules.

3. Given the limited grievance that the petitioner has, this Court is of the opinion that the writ petition itself can be disposed of at this juncture. Accordingly, subject to verification of the facts and entitlement of the petitioner in terms of the service regulations and rules particularly keeping in mind the fact that the circular of the State Govt. dated 17.02.2004 already stands cancelled by the State Govt. vide order dated 14.06.2013, let an appropriate decision be taken by the authorities concerned at the earliest preferably within a period of 90 days from the date of receipt of copy of this order.
