(2) Learned counsel appearing for the petitioner submits that

the petitioner is working on the post of Panchayat Secretary, Amarpur and by the impugned orders dated 05.1.2017 and 12.01.2017 passed by respondent No.5 i.e. Chief Executive Officer, Janpad Panchayat, Baikunthpur has withdrawn the financial power of petitioner without giving any opportunity of hearing to him and therefore, he may be permitted to file fresh representation before respondent No.4 i.e. Chief Executive Officer, Zila Panchayat, Koriya for redressal of his grievances and direction may be issued to the said authority to decide the same expeditiously.

(3) Prayer appears to be fair and reasonable.

(4) The petitioner is permitted to file a fresh representation before respondent No.4 i.e. Chief Executive Officer, Zila Panchayat, Koriya. If such representation is made by the petitioner within 15 days from today and, in turn, respondent No.4 shall consider and decide the same on its own merit and in accordance with law preferably within a period of 30 days from the date of receipt of copy of this order along with representation of the petitioner.

(5) With the aforesaid observation, the petition stands finally disposed of. No order as to cost(s).
