(2) Learned counsel appearing for the State would submit that the impugned order dated 18.11.2016 (Annexure P/9) passed by respondent No.1 against the petitioner is appealable before the appellate authority under Rule 23(i) as provided under Section 24(1)(i)(b) of the Chhattisgarh Civil Services (Classification,

Control & Appeal) Rules, 1966.

(3) At this stage, learned counsel appearing for the petitioner would submit that the petitioner may be allowed to prefer an appeal before the appellate authority within three weeks from today.

(4) The prayer appears to be fair and reasonable. (5) The petitioner is permitted to prefer an appeal before the appellate authority. If such appeal is filed by the petitioner within a period of three weeks from today, the concerned authority shall consider and decide the same in accordance with law and on its own merit expeditiously from the date of receipt of the appeal of the petitioner.

(6) With the aforesaid observation, the writ petition stands disposed of. No order as to cost(s).
