HIGH COURT OF CHHATTISGARH, BILASPUR Writ Petition (C) No. 2937 of 2016 Devendra Kumar Yadav S/o Shri Ram Surat Yadav, aged about 36 years, R/o Plot No. 3/ B, Ward No. 38, Hari Nagar, Katul Bod, Durg, (Chhattisgarh) ---- Petitioner

Versus

1. State of Chhattisgarh through the Secretary, Department of Scheduled Tribe and Scheduled Caste Development, Mahanadi Bhawan, Mantralaya, Post & PS Mandir Hasaud, Raipur, (Chhattisgarh)

2. Sub Divisional Officer and Competent Authority, Manendragarh, District Koriya (Chhattisgarh) ---- Respondents 09.12.2016 Shri Arvind Dubey, counsel for the petitioner. Shri Shashank Thakur, G.A. for the State.

Heard on I.A. No.01 for amendment in the cause title.

Counsel for the petitioner submits that inadvertently the address of Respondent No.2 has been shown Durg in stead of Manendragarh in the cause title and prays for amendment of the same.

Not opposed by the State counsel.

Accordingly, I.A. No.01 is allowed. Let necessary amendment be carried out during the course of the day. Heard on admission.

Admit.

Counsel for the petitioner submits that the sole grievance of the petitioner for filing of the present writ petition is that in spite of repeated efforts being made, his application for grant of social status certificate is not being entertained by the respondent no.2. He further submits that on the previous date of hearing i.e. on 30.11.2016 this Court had directed the State counsel to seek instruction from the competent authority.

In this regard, Govt. Advocate submits that he has specific instruction that the authority concerned was not aware of any such efforts made by the petitioner. He further submits that now, if the petitioner approaches the respondent no.2 and moves an appropriate application, the same shall be entertained and an appropriate order shall passed after due verification.

At this juncture, counsel for the petitioner submits that in view of the submission made by the State counsel nothing further remains in this petition for adjudication. Accordingly, it is directed that the petitioner shall now approach the respondent no.2 by moving appropriate application for grant of social status certificate and upon receipt of the said application, respondent no.2/the concerned competent authority shall make all necessary enquiry and pass an appropriate order in accordance with law as expeditiously as possible.

With the aforesaid observation the present petition stands disposed of.
