The applicant has preferred this bail application under Section 439 of the CrPC, as he has been arrested in connection with Crime No.149/2019, registered at Police Station Bango, District Korba (C.G.) for the offence punishable under Sections 302 & 201 read with Section 34 of IPC.

The applicant Golu @ Jagdish Kanwar was doubting the character of his wife, therefore, he hatched conspiracy with his uncle Naresh to eliminate the deceased and in execution thereof, he hired Bolero vehicle of Sandip Yadav. The deceased was taken to the forest by all 4 accused persons, but only the present
applicant and his uncle Naresh went inside the forest, committed murder and buried the dead body. When the body started deteriorating, it was exhumed and the identity was established. The applicant being the husband of the deceased did not lodge any report nor informed anybody that his wife is missing. Sandip Yadav has been enlarged on bail in MCRC No.7316/2019 on the ground that his vehicle has been used but he did not participate in committing murder.

Considering the gravity of the offence, this Court is not inclined to enlarge the applicant on bail.
