1. Heard.

2. The applicant has preferred the first bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No.29/2021, registered at Police Station Lundra, District- Surguja (C.G.) for the offence punishable under Section 420 of the Indian Penal Code and Section 66 (c) of the Information Technology Act.

3. The applicant has obtained One Time Password (O.T.P.) of the Paytm account of grandfather of his girlfriend-Monika and withdrew Rs.3,50,000/- from his account by surreptitiously and discreetly using the O.T.P.

4. Learned State counsel would oppose the prayer for grant of bail.

5. Considering that the applicant is in jail since 09-04-2021; the offences are triable by Judicial Magistrate First Class and the charge sheet has already been filed, I am inclined to release the applicant on bail

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court.
