Agrawal Order On Board /07/201 (1) Counsel for the petitioner submits that respondent No. 5- Chief Municipal Officer, Nagar Panchayat, Bhakhara has initiated process for demolition of his house and shop without being given any notice to him.

(2) Per contra, learned counsel for the State would submit that

at present no action for demolition of petitioner's house / shop is being taken and whenever the action will be taken, opportunity of hearing will be given to the petitioner.

(3) I have heard learned counsel appearing for the parties and perused the order impugned with utmost circumspection. (4) Be that as it may, it is directed that if the action proposed against the petitioner regarding demolition, in fact competent authority will issue notice to the petitioner and after giving due opportunity of hearing to the petitioner, pass the appropriate order in accordance with law.

(5) With the aforesaid observations, the writ petition stands finally disposed of.
