(2) Learned counsel appearing for the State/respondent submits that the impugned order dated 24.06.2016 (Annexure P-1) passed by respondent No.3 i.e. Collector, Raigarh is appealable before the appellate authority.

(3) At this stage, learned counsel appearing for the petitioner submits that the petitioner may be permitted to prefer an appeal before the appellate authority within a period of three weeks from today.

(4) The prayer appears to be fair and reasonable. (5) The writ petition is accordingly disposed of with a direction to the petitioner to prefer an appeal before the appellate authority. If such appeal is filed by the petitioner within a period of three weeks from today and, in turn, the appellate authority shall consider and decide the same in accordance with law preferably within a period of 45 days from the date of receipt of appeal along with copy of this order, after affording proper opportunity of hearing to the parties.
