Ashwani Kumar Sharma v. State Of Chhattisgarh And ANR.
NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPS No. 1172 of 2015 • Ashwani Kumar Sharma S/O Late Bhuneshwar Prasad Sharma, Aged About 54 years, Working As Dresser Grade - I, Civil Hospital Mana Camp, Raipur Chhattisgarh R/O Village Nawapara, Rajim Tahsil Rajim District Raipur Chhattisgarh ---- Petitioner
Versus
1. State Of Chhattisgarh Through The Secretary, Health Department, Mahandi Bhavan, Mantralaya, New Raipur, District Raipur Chhattisgarh
2. The Chief Medical & Health Officer Raipur, District Raipur Chhattisgarh ---- Respondents For Petitioner : Shri U.R. Koshaley, Advocate For Respondent/State : Shri Shashank Thakur, Govt. Advocate Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 07/04/2015 1.
Petitioner is aggrieved by the impugned order of posting whereby he has been posted as Peon in the Community Health Centre, Nawapara, Block Abhanpur, District Raipur which is his original place of posting. 2.
Learned counsel for the petitioner would submit that the petitioner was earlier promoted on 23/05/2008 on the post of Dresser-II, however, the said order was amended and a fresh order was issued on 29/05/2008 wherein petitioner's name was not mentioned, therefore, the earlier order of promotion stood withdrawn. He would submit that in stead of promoting the petitioner from the post of Peon to the post of Dresser-II he is shifted to a new place which is about 25 Kms. away from the present place of posting.
3.
A reading of the impugned order would itself indicate that there exists administrative exigency for posting the petitioner at his original place of posting because at that place a new building has been constructed where for services of a Watchman is required. Even otherwise petitioner is only relieved for joining at his
original place of posting therefore, for this reason also no infirmity can be found with the impugned order.
4.
There is no substance in this writ petition, which fails and is hereby dismissed.
