Proceeding Through Video Conferencing Hon'ble Shri Prashant Kumar Mishra, Ag CJ Order On Board 22/07/2021 :

1. Since both the applications have been preferred by the same applicant, though for different offences, they are being decided together.

2. The applicant has preferred these applications for grant of bail as he is

MCRC No. 3656/2021 & MCRC 3684/2021 arrested in connection with Crime Nos.103/2021 & 390/2021 registered in Police Station: Newai District Durg for offence under Section 457 & 380/34 of the IPC.

3. In MCRC No.3656/2021, the allegation is of commission of theft of Rs.12,000/- from the house of complainant Shivnath Agrawal. In MCRC No.3684/2021, the applicant along with 3 other accused persons have committed theft of gold & silver ornaments, laptop and camera etc. amounting to Rs.1,58,412/-.

4. In both the cases, the applicant has been arrested on 10.4.2021. Except these two cases, no other offence is registered against the applicant.

5. Considering that the applicant is in jail since last more than 3 months and the offences are triable by the Judicial Magistrate 1st Class, I am inclined to release him on bail.

6. Accordingly, the applications are allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
