Petitioner, a Constable working at M.T. Workshop, Raipur was posted in the said office by order dated 17/01/2014. When the petitioner was not relieved he preferred W.P.(S) No. 5288/2014 which was disposed of on 15/10/2014 directing the State Government to comply with the transfer order, if the same is still in existence. Accordingly the petitioner was relieved from 7th Battalion M.T. Workshop, Bhilai on 13/02/2015 and thereafter he joined at the present place of posting on 12/03/2015. Within three weeks of his joining at the M.T. Workshop, Raipur he has again been posted by the impugned order, to 7th Battalion S.A.F. Bhilai. 2.
Learned counsel for the petitioner would submit that the impugned order has been passed to circumvent the direction issued by this Court and in any case, this
amounts to fresh transfer within a period of one month from the date when the earlier order is complied with.

Considering the entire fact situation of the case, the writ petition is disposed of with a direction that in the event petitioner prefers representation against the impugned order within a period of one month from today, the competent authority shall consider and decide the representation at the earliest, preferably within a period of three months. Till the petitioner's representation is decided or for a period of four months, whichever is earlier, the impug ned order shall remain in abeyance. J U D G E Kamde
