(2) Learned counsel appearing for the petitioner would submit that the impugned order dated 29.08.2016 (Annexure P-1) passed by respondent No.4 i.e. Chief Executive Officer, Zila Panchayat, Mahasamund is appealable before the appellate/competent authority and therefore, he may be permitted to prefer an appeal before the appellate/competent authority

within a period of four weeks from today.

(3) The prayer appears to be fair and reasonable. (4) The writ petition is accordingly disposed of with a direction to the petitioner to prefer an appeal before the appellate/competent authority. If such appeal is filed by the petitioner within a period of four weeks from today and, in turn, the appellate/competent authority shall consider and decide the same in accordance with law, after affording proper opportunity of hearing to the parties preferably within a period of two months from the date of receipt of appeal along with copy of this order.
