The applicant has preferred this first bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.66/2020, registered at Police Station Khursipar, District - Durg (CG), for the offence punishable under Section 363, 366, 376(2), 376(2)(n), 376(3) & 306 of the Indian Penal Code and Section 6 of the Protection of Children from Sexual Offences Act, 2012.

3. The applicant on promise to marry the deceased, aged about 15 years, brought her to his house where they were staying together, however, because of cruelty committed by the applicant she committed suicide on 9-10-2019.

4. Learned counsel appearing for the State would oppose the bail application.

5. As per material available in the case diary the deceased was residing with her father, as her mother had died in a landslide incident while they had gone for Goddess Vaishno Devi Darshan. Compensation of Rs.3.00 lacs was received by the family on account of death of mother of the deceased. The said amount was deposited in the form of Fixed Deposit (FD) in the name of the deceased. The present applicant had an eye over the said amount, therefore, in a planned manner he brought the deceased to his house on promise to marry her.

6. Considering the seriousness of the offence and the nature of evidence available on record, this Court is not inclined to grant bail to the applicant.
