Shri Mayank Chandrakar, Advocate for the respondent. The present contempt petition has been filed alleging willful disobedience of the order dated 11.12.2018 passed in WPS No.8185 of 2018.

The respondent have entered appearance and have produced a document Annexure R/7, dated 31.08.2019, whereby the representation of the petitioner has been rejected on the ground that the set up in the secretariat does not permit promotion from the post of Field Worker to the post of Lab Assistant. He further submits that subject to the rules being amended to that extent, the case of the petitioner shall be considered. Today, the counsel for the petitioner as well as the respondent submit that the rules have since been amended in February, 2020 and the amendment now provides promotion to the post of Lab Assistant from the post of Field Worker. Thus, the petitioner henceforth would become eligible for promotion.

Given the fact that the rules also now have been amended and as per Annexure R/7 issued by the respondent, the case of the petitioner shall be considered for promotion on the rules getting amended, it is expected that the respondent shall take appropriate steps in accordance with the amended rules at the earliest.

As of now, the order dated 11.12.2018 stands fully complied with and therefore the contempt petition stands disposed of and the respondent stands discharged from the contempt proceeding. The petitioner would be at liberty to file a fresh writ petition in case if his grievance still survives.
