This Appeal is directed against the judgment dated 8.3.2007 whereby the learned Single Judge did not take any action under the Contempt of the Court Act, against the Respondent and disposed of the Contempt Petition. 2.
The learned Single Judge held that part of the judgment dated 11.2.2004 passed in W.P No.3737/2003 had been complied with and as far as payment of salary for the period due was concerned, the learned Single Judge held that it is for the Respondent to pass an appropriate order whether such request can be accepted or not in the absence of any certificate.

This order has not been passed in the exercise to punish for contempt and therefore, no Appeal is maintainable in terms of Section 19 of the Contempt of Court Act. Therefore, without going into the merits of the case, we hold that the Appeal is not maintainable and the same is accordingly dismissed.
