1. Heard.

2. The applicant has preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.143/2019 registered in Police Station Pratappur, District- Surajpur C.G. for the offence punishable under Section 306 of the I.P.C.

3. Case of the prosecution, in brief, is that applicant was in love with deceased - Sita Ravi. Initially the village Panchayat

MCRC No. 4075 of 2020 decided to allow them to marry, thereafter it was decided that being members of the same family she would be married to some other person and till marriage happens, applicant will not perform marriage. Despite this decision applicant's marriage with some other girl was fixed and the marriage ceremonies began on 14.06.2019 for which she committed suicide by jumping into irrigation Dam.

4. Learned State counsel would oppose the prayer for grant of bail.

5. Considering the nature of allegation and for the fact that applicant is in jail since 30.12.2019 and the charge sheet has already been filed, this Court is inclined to release the applicant on bail.

6. Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of ₹50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
