(2) Learned counsel appearing for the petitioner would submit that the petitioner's father died in harness on 17.02.2003 while working as Incharge Head Master Primary School, Chhindgaon. The petitioner has made an application for appointment on compassionate ground which is pending consideration before the respondent No.3 and as the same has not been considered and decided till this date in accordance

with law and, therefore, a direction may be issued to respondent No.3 to decide the same expeditiously.

(3) Prayer appears to be fair and reasonable.

(4) Be that as it may, respondent No.3 i.e. District Education Officer, Balod is directed to consider and pass an appropriate order on application of the petitioner for compassionate appointment in accordance with law expeditiously preferably within a period of 45 days from the date of receipt of copy of this order. (5) It is made clear that this Court has not expressed any opinion on the merits of the case and the authority concerned is free to decide the application of the petitioner in accordance with law. (6) With the aforesaid observations, the writ petition stands disposed of.
