NAFR HIGH COURT OF CHHATTISGARH, BILASPUR Misc. Appeal (C) No. 1130 of 2012 Shyamuram Kashyap son of late Khotlu Ram, aged about 20 years, caste Muriya, residence of Dimparapal, P.S. Parpa (Frajerpur) Gramin Thana, Tahsil Jagdalpur, District Bastar, Chhattisgarh ---- Appellant

Versus

Jeevan Singh Thakur Son of Dharam Singh, aged about 42 years, Panchayat Secretary, village Tokapal, Tahsil Jagdalpur, District Bastar (CG) Vehicle owner and driver Motorcycle No. CG 17B/7318 ---- Respondent For Appellant :

Shri C. Jayant K. Rao, Advocate Hon'ble Shri Justice P. Sam Koshy Order On Board 23/02/2018 Present is an appeal by the claimant under Section 173 of the Motor Vehicles Act. The challenge in the present appeal is to the award dated 29.06.2012 passed by the 2nd Additional Motor Accident Claims Tribunal, Bastar at Jagdalpur (CG) in Claim Case No. 107/2012. Vide the impugned award, the Tribunal in an injury case under Section 166 of MV Act has awarded compensation of Rs.3,000/- to the claimant. 2.

It is this award which is under challenge in the present appeal. 3.

A perusal of the record would show that the appellant has not been able to establish before the Tribunal as to the exact nature of injury that has been sustained by him neither was there any sufficient material to show the expenses incurred in the course of treatment neither was there any evidence of a medical expert recorded during the course of hearing.

4.

Under these circumstances, the finding of the Tribunal awarding compensation of Rs.3,000/- does not seem to be either erroneous or unreasonable in any manner.

5.

Thus, the appeal being devoid of merit stands dismissed. Sd/- (P. Sam Koshy) JUDGE Bhola
