At the outset, learned counsel for the appellant would submit that the respondent had filed execution proceeding before the Court below for compliance of order dated 31-07-2009 and thereafter has withdrawn the same, further submitted that the respondent had filed a civil suit under Section 13 of the Hindu Marriage Act, 1955 which was registered as Civil Suit No.11A/2012 before the District Judge, Jashpur, C.G. The learned trial Judge after hearing the parties vide judgment dated 29-01-2015 allowed the said Civil Suit and granted decree of divorce under the law in favour of the respondent. Against the said judgment present appellant also preferred F.A.(M) which is pending before this Court. With this, he is not pressing the instant FAM with liberty to raise all the issues for the cause available under the law. 2.

As submitted, the instant FAM is disposed of without any appreciation on its merit reserving the aforesaid liberty if available under the law. 3.

The FAM disposed of.
