The present is a jail appeal preferred by the appellant-Farsuram who stands convicted for the offence punishable under Section 307 IPC and has been sentenced to undergo RI for five years with fine of Rs.200/- with default stipulation of additional RI for two months in the event of non payment of fine amount vide judgment dated 28.10.2006 passed by the Sessions Judge, Bastar, in Sessions Trial No.113/2006. 2.
A report has been received from the jail authorities that the appellantFarsu Ram, in due course of time, has completed his sentence and has been released from jail on 26.01.2009. Further, the State counsel also produces a report of Sarpanch of Gram Panchayat, Baniyagaon which is based upon the statements of mother and brother of the appellantaccused to the effect that the appellant has died in October, 2010. Sub Inspector, Kondagaon, has also given a report affirming death of
-2appellant in October, 2010. None of the family members of the appellant has come forward for further prosecuting the case. 3.
In view of the fact that the appellant-accused having completed his sentence released from the jail and subsequently died in October, 2010. Further, none of the family members intends to prosecute the appeal any further, in the opinion of this court, nothing further remains to be adjudicated upon. The appeal thus stands dismissed as having abated.
