1. The applicant have preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as they are arrested in connection with crime No.222/2021 registered in Police Station Outpost Manikpur, Police Station Kotwali, Korba, District Korba C.G. for the offence punishable under Sections 406, 420 read with Section 34 of the I.P.C.

2. Applicants have induced and deceived many villagers by seeking financial assistance pretending that their mother needs treatment being seriously ill. Applicants have collected Rs.14 Lacs cash and 10 tola gold from the villagers.

3. Learned State counsel would submit that applicants are involved in one more case of similar nature and have in fact cheated many villagers, therefore, they are not entitled to be released on bail.

4. In similar matter bearing MCRC No.3971/2021, this Court has allowed bail to the present applicants, therefore, considering that the offence is triable by JMFC as also for the fact that they are in jail since 01.4.2021 and applicant No.2 is a lady, aged about 41 years, I am inclined to release the applicants on bail.

5. Accordingly, the application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
