2. Director, Directorate Of Higher Education, Indrawati Bhawan, Atal Nagar, Raipur, District- Raipur, Chhattisgarh
3. Principal, Government Rajiv Gandhi Post Graduate College Ambikapur, District- Surguja, Chhattisgarh ---- Respondents For Petitioner :
Shri Shashank Thakur, Advocate For State :
Shri P. Acharya, P.L.
Hon'ble Shri Justice P. Sam Koshy Order on Board 15.04.2019
1. The limited grievance raised by the petitioner in the present writ petition is for payment of salary payable to the petitioner from July, 2016 to July, 2017 which has not been paid to him.
2. Contention of the counsel for the petitioner is that the petitioner had
during the said period discharged his duties as a Sports Officer under respondent no.3 but he has not been paid his salary. Counsel for the petitioner referred to Annexure P-5 dated 04.01.2018 passed by respondent no.1 which shows that respondent no.1, on a representation being made by the petitioner, had directed respondent no.3 to take necessary steps for releasing the unpaid salary to the petitioner. According to him, more than one year has lapsed but till date no step has been taken by respondent no.3 for releasing the unpaid salary.
3. Given the said facts and circumstances of the case, this Court is of the opinion that no fruitful purpose would be served in keeping the writ petition pending rather ends of justice would meet if the writ petition is disposed of with a direction to respondents 2 & 3 to ensure that the issue regarding unpaid salary of the petitioner is settled as per the order passed by the Additional Secretary of the Department dated 04.01.2018 Annexure P-5, at the earliest preferably within a period of 3 months from the date of receipt of copy of this order .
