1. Heard.
2. The applicants have preferred the first bail application under Section 439 of the Cr.P.C., as they are arrested in connection with Crime No.223/2021, registered at Police Station - Outpost Manikpur, P.S. Kotwali, Korba, District- Korba (C.G.) for the offence punishable under Sections 406, 420 r/w 34 of the Indian Penal Code.

3. The applicants have obtained payment of Rs.14,50,000/-, Twenty Tola Gold and 500 gm Silver from different victims on the pretext that they are in need of funds for treatment of their mother who is seriously ill.
4. Shri Chandresh Shrivastava, learned State counsel and Shri Anil Gulati, counsel for the objector would vehemently oppose the prayer for grant of bail. They would submit that the applicants have cheated many villagers, therefore, they are not entitled to be released on bail.
5. Considering that the offences are triable by Judicial Magistrate First Class; charge sheet has already been filed and the applicants are in jail since 01-04-2021 i.e. for about four months and also the applicant No.1 is a lady aged about 41 years, I am inclined to release the applicants on bail.
6. Accordingly, the bail application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court.
