1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.291/2020 registered in Police Station: Jainagar District Surajpur for offence under Section 302 and 201/34 of the IPC.

2. As per the prosecution case, dead body of deceased Harish Rajwade was found near electric sub station Karwa at about 8 am on 23.11.2020. During investigation, it was revealed to the police that the present applicant along with Vijay Kumar Vishwakarma and Sanjay Kumar Vishwakarma were consuming liquor at the sub station and at the same time the deceased reached there, requested them for sharing liquor, on

MCRC No. 3897 of 2021 which a quarrel took place. Co-accused Vijay Kumar Vishwakarma hit the deceased by wooden log over his head and the dead body was later on thrown on the road in front of the sub station.

3. Admittedly, co-accused Vijay Kumar Vishwakarma and Sanjay Kumar Vishwakarma have already been released on bail by the coordinate Bench in MCRC Nos.1163/2021 & 2153/2021 respectively. Case of the present applicant is more or less similar to the case of co-accused persons who have already been released on bail. Therefore, this Court is inclined to release the applicant on bail.

4. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
