At the very outset, learned counsel for the applicant would submit that at the time of filing of charge sheet offence under Section 409 of the Indian Penal Code has been added.

The applicant has preferred this bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.35/2021, registered at Police Station Mana Camp, Raipur (CG), for the offence under Sections 406, 420 & 409 of the Indian Penal Code.

Applicant has failed to make payment of Rs.57.00 lacs as price of sugar supplied to him by the complainant. 5.

Learned counsel for the State, per contra, would oppose the bail application.

Admittedly, co-accused Chandresh Kumar Natvarlal Madhu @ Chandresh Madhu has been released on anticipatory bail in MCRCA No.664 of 2021 whereas the present applicant has been released on anticipatory bail in MCRCA No.512 of 2019 and 513 of 2019 in respect of Cr.No.101/2019 & 102/2019, respectively.

Considering the facts situation of the case, as also for the fact that the applicant is in jail since 9-3-2021 and the charge sheet has already been filed, I am of the opinion that present is a fit case to release the applicant on regular bail. 8.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
