Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 23/12/2016 Upon instructions, State counsel submits that as far as the present petitioner is concerned, he had not given his consent for transfer. Considering the aforesaid submission, it is clear that the petitioner could not be relieved on the ground of transfer because he was not transferred vide order dated 23/09/2016.

Accordingly, order dated 11/11/2016 (Annexure P/1) shall not be given effect to in respect of the petitioner. However, it will be open for the respondents

to take other administrative measures as may be necessary on administrative exigency.
