(2) Learned counsel appearing for the State/respondents submits that the impugned order dated 13.10.2016 passed by respondent No.3 i.e. District Education Officer, Surajpur is appealable before the appellate authority.

(3) Learned counsel appearing for the petitioner submits that the petitioner may be permitted to prefer an appeal before the appellate authority within a period of one month from today. (4) Prayer appears to be fair and reasonable.

(5) Accordingly, the petitioner is permitted to file an appeal before the appellate authority. If such appeal is filed by the petitioner before the appellate authority within a period of one month from today, the concerned authority shall consider and decide the same on its own merit and in accordance with law preferably within a period of three months from the date of receipt of copy of this order along with appeal.

(6) With the aforesaid observation, the petition stands finally disposed of. No order as to cost(s).
