This is first bail application under Section 439 of the Cr.P.C. preferred by the applicants before this Court and no other bail application is pending before any other Court. 2.

Perused the case diary provided by the learned counsel for the State in connection with Crime No.17/2019 registered at Police Station- Through PS Lalpur Tahsil Lormi, District- Mungeli (C.G.) for the offence punishable under Sections 394, 417/34, 419, 170 of Indian Penal Code.

Case of the prosecution, in brief is that on 31.01.2019, complainants Danial Dahire and Chhatrapal were coming from Govindpur Bazar to Mungeli along with Maneesh Kurre and Gorakhnath Kurre. Near village Kanteli, 4 unknown persons started quarreling with them. They snatched cash of Rs.4,000/-, one mobile of Redmi make, from the pocket of complainant Danial Dahire. 20-30 bundles of clothes were also looted. They also Looted Rs.500/- along with purse from complainant Chhatrapal. During Identification Parade, complainant Danial Dahire identified the applicants. 4.

Learned counsel for the applicants submits that applicants have no criminal background, they are innocent and have been falsely implicated in the present case, therefore, they shall be released on bail.

On the other hand, learned counsel for the State opposes the bail application, however, submits that three other criminal cases have been registered against the applicant No.1 Rajkumar Patre, out of which one under IPC and two under CrPC and no criminal antecedent has been reported against the applicant No.2 Shatrughan. 6.

Looking to the above mentioned facts and circumstances of the case, looking to the fact that there is no likelihood of the accused to abscond and tamper the evidence, it is ordered that if each applicant furnishes two solvent sureties for a sum of Rs.25,000/- along with a personal bond of Rs.50,000/- to the satisfaction of the concerned trial Court with the condition that he will appear before the trial Court at 11:00 am as and when directed till trial and he would cooperate during the trial, he shall be released on bail.
