Hon'ble Shri Justice P. Sam Koshy Order On Board 28.08.2018 The present contempt petition has been filed alleging the willful non compliance of the order passed by this Court on 19.02.2018 in WPS No. 1556 of 2018.

The order passed by this Court was a stay order against an order of transfer dated 14.08.2017. This Court had called upon the respondent before this Court who on appearance submits that the Department has given the petitioner joining but it was the petitioner who in turn was refusing the work at the place where he was posted which has created all the complications.

The petitioner as well as the respondent are present before this Court today. The respondent contemnor has accepted the fact that he is willing to

provide joining to the petitioner where he was working prior to the interim order was granted by this Court on 19.02.2018 and the petitioner present before this Court is ready to report for duty on joining being provided by the respondent.

Given the facts, let the respondent take all necessary steps to provide joining to the petitioner at the place where he was posted prior to the issuance of the transfer order under challenge in WPS No. 1556/2018. 5.

With the aforesaid observation, the contempt petition stands disposed of.
