Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 03/07/2017 (1) Learned counsel appearing for the petitioner would submit that the petitioner's substantive appeal against the order of cancellation of lease dated
17.04.2013 is pending consideration before the respondent No. 6- Managing Director, Chhattisgarh State Industrial Development Corporation Limited since 07.05.2013, which has not been heard and decided till now. He submits that application for interim relief has also been filed along with that appeal but the same has also not been decided by respondent No. 6; and on the contrary order dated 17.05.2017 (Annexure P-1) has been passed for dispossession of the petitioner from the land i.e. Plot No. 538, area 15000 sq.ft. and, therefore, a direction may be issued to respondent No. 6 to decide the appeal and application for grant of interim relief expeditiously. (2) Be that as it may, the respondent No. 6 is directed to decide firstly the application for interim relief within a period of 15 days from today and then decide the appeal within a period of three months from the date of receipt of copy of this order in accordance with law.
(3) For the period of 15 days, the petitioner shall not be dispossessed from the suit property.
(4) With the aforesaid observations, the writ petition stands finally disposed of.
