1. The applicant has preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.275/2021 registered in Police Station City Kotwali, Durg District Durg C.G. for the offence punishable under Section 392 of the I.P.C.

2. Case of the prosecution, in brief, is that applicant has committed loot of one mobile set valued at Rs.5000/- .

3. Learned State counsel would oppose the prayer for grant of

MCRC No. 3760 of 2021 bail.

4. Considering the entire fact situation of the case as also for the fact that applicant is in jail since 29.3.2021; offence is triable by JMFC and the charge-sheet has already been filed, I am inclined to release the applicant on bail.

5. Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
