1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.2/2019 registered in Police Station: Samripat District Balrampur-Ramanujganj for offence under Section 232, 341, 427, 394, 435, 399, 120-B, 212 & 299 of the IPC, Section 3, 5 & 8 of the Chhattisgarh Public Security Act, 2005 and Sections 25, 27 & 30 of the Arms Act.

2. This is the 3rd bail application on behalf of the applicant. The first bail application was decided on 14.8.2019 in MCrC No.4702/2019 on merits, and the second bail application bearing MCRC No.7571/2020

MCRC No. 3728 of 2021 was dismissed as not pressed on 17.12.2020. The present bail application was admitted for hearing, as the applicant is in jail since 14.2.2019.

3. As per the prosecution case, informant Sonu Kumar Verma is the Poclain Machine driver at Rajendrapur Hindalco Bauxite Mines. When he was working in the mines on 3.1.2019, 4 unknown persons came to the mines at about 11.15 pm, obstructed his work, brought him down from the Poclain Machine, looted his mobile, assaulted and set ablaze the Poclain Machine.

4. During investigation, the applicant was not put to TI parade for establishing his identity.

5. Considering the quality of evidence appearing in the examination of material witnesses and mainly for the fact that the applicant is in jail since 14.2.2019, I am inclined to release him on bail.

6. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one local surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
