The applicant has preferred this bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.54/2021 registered at Police Station Fasterpur, District Mungeli (CG), for the offence punishable under Sections 294, 506, 323, 376, 34 of the Indian Penal Code.

Applicant has committed forcible sexual intercourse with the prosecutrix and at the same time filthily abused, assaulted and criminally intimated her at the time of incident.

Despite the fact that the prosecutrix has sweared affidavit according no objection in applicant's release on bail, I am of the opinion that present is not a fit case to release the applicant on regular bail at this stage.
