1. This is first bail application filed u/s 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No. 57 of 2017 registered at police station- Bhilai-3, District- Durg (C.G.) on the allegation of having committed offence under section 294, 341, 147, 148, 149, 186, 353, 427, 435 & 307 of IPC.

2. The case of the prosecution is that in a mob frenzy after a road accident resulting in death, the applicant and coaccused used criminal force and assaulted the police official.

3. Learned counsel for the applicant would submit that the applicant and many other villagers have been falsely implicated on exaggerated version though no such offence was committed by the applicant. He would further submit that the other accused of this incident namely Bhuneshwar Patel, Suraj Sahu, Nanhe Lal Kaushal, Chhote Sahu, Sunil Manikpuri, Raju Verma, Rajesh Dewangan, Yogendra Thakur

& Vikky Verma have been granted bail by this Court, therefore, the present applicant may also be granted bail as investigation in this case is also complete and the chargesheet has been filed.

4. On the other hand, learned State counsel opposes the bail application.

Taking into consideration the submission of the learned counsel for the parties perusing the case diary and that the investigation is complete, charge-sheet has been filed and further the case of the present applicant appears to be similar to those who have already been granted bail by this Court in MCRC No. 5771 of 2017, 5877 of 2017 4328 of 2017, 4330 of 2017, 4346 of 2017 and 6268 of 2017, the present application is also allowed.

6. Accordingly, it is directed that the applicant shall be released on bail on his furnishing a personal bond in sum of Rs. 25,000/- with one surety in the like sum to the satisfaction of the trial court for his appearance before the said court as and when directed.
