The writ petition has already been dismissed for non-prosecution. Though, there is a long delay in moving application for restoration along with application for condonation of delay, taking into consideration the reasons which has been assigned in the application and particularly taking
into consideration that the cases which is transferred from State Administrative Tribunal and the applicant is retired from Government service, the order of dismissal dated 15.03.2010 for want of prosecution is recalled and Writ Petition(S) No.1938 of 2005 is restored to its original number.
The MCC is accordingly allowed.
