Agrawal Order On Board 24/04/2018 (1) Learned counsel appearing for the respondent would submit that impugned order is appealable before the State Transport Appellate Tribunal under Section 89 of the Motor Vehicles Act, 1988 (henceforth "Act, 1988").

(2) In view of above, learned counsel appearing for the petitioner would submit that the petitioner may be allowed to prefer appeal before the appellate authority under Section 89 of the Act, 1988 and the same may be directed to be decided expeditiously. (3) I have heard learned counsel appearing for the parties. (4) Be that as it may, the petitioner is permitted to prefer appeal before the appellate authority within a period of 15 days from today and in turn, the appellate authority shall consider and decide the same expeditiously preferably within a period of three months

from the date of filing of the appeal.

(5) With the aforesaid observations, the writ petition stands finally disposed of. (6) Certified copy of the impugned order be returned to the counsel for the petitioner, after furnishing an attested photocopy thereof. Sd/- (Sanjay K. Agrawal) Judge D/-
