1. Learned counsel for the petitioner submits that the petitioner has come before this Court with a limited prayer that the proceedings which is pending before the Tehsildar, Akaltara, District Janjgir-Champa in revenue case No.41/A-70/16-17 is being not expedited as in that revenue case the encroachers were directed to remove their encroachment over the government land, whereby easementary right of the petitioner are being affected and he is not allowed to go into his field to cultivate.
2. Perused the document. It shows that certain notices were issued to Koushalya w/o Ramaiya and Titra S/o Darshram that they have encroached
upon certain land bearing Khasra No.409/2 & 497/2 at village Amora. The said notices were issued on an application made by the petitioner and order was passed by the Tehsildar. The record as would reveal that the letter was addressed to SHO, Mulmula by the Tehsildar, Akaltara for execution of order of Tehsildar. Considering the fact that only the limited prayer is made, the Tehsildar, Akaltara is directed to conclude the proceedings of revenue case No.41/A-70/16-17, within a further period of 45 days from the date of receipt of this order. It is further made clear that the Tehsildar shall be obliged to execute its own order and may seek necessary help from police in case of need and the respective Station In-charge shall provide all the necessary support to the Tehsildar to execute the order, if any so passed.
