1. Heard.

2. This is an application filed under Section 439 of the Code of the Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.916/2020 registered at Police Station Thana Kotwali, District Raigarh (CG) for the offence punishable under Sections 294, 506, 323, 452, 325, 34 of the IPC.

3. The present applicant along with co-accused Sandeep, Rakesh and Kapil have caused injuries over the person of Shyama Bai

Chouhan and Manish Chouhan causing fracture of his right forearm.

4. Learned counsel for the State would submit that the applicant has five previous antecedents.

5. Learned counsel for the applicant submits that out of the five cases, two have already entered in compromise and in none of the case, any heinous offence is involved. He would further submit that co-accused Rakesh Sidar has already been released on bail in MCRC No.1118/2021 vide order dated 17.6.2021.

6. Considering the entire facts situation of the case and for the fact that the offences are triable by the Judicial Magistrate First Class and the applicant is in jail since 3.4.2021 and the charge sheet has already been filed, this Court is inclined to release the applicant on regular bail.

7. Accordingly, the application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
