The applicant has preferred this second bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.231/2019, registered at Police Station Gariyaband, District Gariyaband (CG), for the offence under Sections 420, 467, 468, 471 of the Indian Penal Code.

The applicant is a Government servant working as Patwari in the Revenue Department of the State Government. He also claimed to be a RTI activist and has posed himself as person belonging to the Government Redressal Cell of the Government of India and for this he has used his letterhead. It is said that the applicant is blackmailing Government officers by using the letterhead in the name of PMO Grievance Redressal Cell.

Considering the entire facts situation of the case; as also for the fact that the applicant is in jail since 11-4-2021 i.e. for about four months; chargesheet has already been filed; as also for the fact that the offences are triable by the JMFC, I am of the opinion that present is a fit case to release the applicant on regular bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
