1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.72/2020 registered in Police Station Sariya, District Raigarh for ofence under Section 21 and 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985.

2. The applicant was found in illicit possession of 120 bottles of WELCYREX cough syrup, each containing 100 ml of syrup. As per the Drug Inspector's report, total quantity of codeine in the said 120 bottles of cough syrup would be 24 gm. Thus the applicant was found in possession of manufactured drug which is more than small quantity but less than commercial quantity.

3. Learned State Counsel would oppose the bail application. However, he would submit that the applicant has no previous antecedents of committing similar nature of crime.

4. Considering that the applicant is aged about 20 years, he is in jail since 27.5.2020 and the charge sheet has already been fled, this Court is inclined to release the applicant on bail.

5. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
